General conditions of sale

Article 1: Scope of application

These general conditions of sale apply to all transactions concluded through the websites of the NICOLE MOFFAT network. Is considered as "client" any natural or legal person making with the company NICOLE MOFFAT an order validated via our secure payment platform, or cash.

Article 1a: Age limit

Age restrictions apply: The company NICOLE MOFFAT only accepts clients over 16 years old (for physical and electronic products) and over 18 years old (for services: coaching, workshops, seminars). We do our best to restrict access to our sites, products and services to minors. Even if the content of our products and services is not of a shocking nature, we prefer to target a mature audience capable of understanding the implications and responsibilities of the business world. Any subscriber/purchaser who does not meet these criteria (age over 16) will be immediately deleted from our database as soon as this is brought to our attention. Likewise, any customer who does not meet these criteria will be immediately reimbursed.

Article 2: Acceptance of Terms and Conditions

Any order placed on a site belonging to the company NICOLE MOFFAT implies full and unreserved acceptance of these general conditions of sale.

Article 3: Products

We sell physical printed books. All product descriptions, pricing and availability are subject to change without notice. We make every effort to ensure product information is accurate, however, variations in printing, color or finish may occur as this is out of our control.

Article 4: Price and Service The prices are indicated in Australian Dollars (AUD) with all taxes included. The price of items can be changed at any time. However, the price applied to an order will be that announced at the time of the order. The price stated excludes shipping costs.

Article 5: Orders An order is confirmed when payments has been received in full; or for schools/kinder orders, when an invoice has been issued and payment received according to invoice terms. We reserve the right to refuse or cancel any order at our discretion. Orders are not processed during Victorian school holidays.

Article 6: Payment

Payment is due immediately on the date of the order. You can pay by credit card. Cards must be international bank cards (Mastercard or Visa). We do not accept American Express. Secure online payment by credit card is made through the company Paypal. The information transmitted is encrypted by software in the rules of the art and cannot be read during transport over the network. Any guarantee as to the security of this system is entirely the responsibility of the company Paypal and cannot be attributed to us.

For invoice-based orders: Payment terms are 14 days from invoice date, by bank transfer. Orders will not be dispatched/delivered until payment is cleared.

Article 7: Shipping

7a Processing times Orders are typically processed within 2-5 business days after payment is received. School and kinder bulk orders may require additional processing time. We will notify you if delays occur. Business days exclude weekends and Australian public holidays. Orders will not be processed or shipped during Victorian school holidays. Books are available through Amazon Australia during this time.

7b Introductory free delivery offer Books will be hand delivered or posted at no cost to schools and kindergartens in the following Melbourne suburbs - Aspendale, Beaconsfield, Beaumaris, Bentleigh, Bentleigh East, Berwick, Black Rock, Bonbeach, Braeside, Brighton, Carnegie, Carrum, Carrum Downs, Caulfield, Chadstone, Cheltenham, Chelsea, Chelsea Heights, Clayton, Dandenong, Dandenong North, Dandenong South, Dingley Village, Doveton, Dromana, Edithvale, Endeavour Hills, Frankston, Hallam, Hampton, Hampton Park, Heatherton, Highett, Keysborough, McCrae, Malvern, Mentone, McKinnon, Moorabbin, Mount Waverly, Mordialloc, Mornington, Mount Eliza, Mount Martha, Noble Park, Oakleigh, Ormond, Parkdale, Patterson Lakes, Rosebud, Safety Beach, Sandringham, Seaford, Springvale, StKilda.

No deliveries will be made during Victorian school holidays.

We reserve the right to end this offer at our discretion.

7c Shipping Methods We ship within Australia using Australia Post. Shipping costs are calculated and included in your invoice.

Delivery is made to the email address you specified when placing your order (therefore, pay particular attention to the spelling of the address you enter). In the event of an email not being received after purchase, please contact us so it can be rectified.

7d Delivery Timeframes Estimated delivery times: Metro 2-6 business days, Regional areas: 3-10 business days. Delivery timeframes are estimates only and cannot be guaranteed. We are not responsible for delays caused by postal/courier services, incorrect delivery details given by the customer, printing delays, events beyond our control.

7e Shipping Address Customers are responsible for providing accurate shipping details (delivery address). We are not liable for orders delivered to incorrect addresses supplied. Additional shipping fees may apply for redelivery.

7f Risk and Title Risk in the goods passes to you upon dispatch. Title to the goods remains with us until payment has been received in full.

Article 8: Returns and Refunds Under Australian Consumer Law, you are entitled to a repair, replacement or a refund if a product - has a major fault, is significantly different from its description, is not of acceptable quality. If your book arrives damaged or faulty please contact us within 7 days of delivery. Provide photos of the damage and include your invoice number. We do not offer refunds for change of mind, incorrect quantities ordered or minor printing variations. return shipping costs for faulty items will be covered by us.

Article 9: Privacy and protection of personal data

We are committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPS).

When you purchase our books, we may collect your personal information including (but not limited to) your name, email address, payment details, and any other information you choose to provide.

We collect this information to:

  • Deliver your products;

  • Process payments;

  • Communicate with you about your purchase, including sending invoices;

  • Improve our services and user experience;

  • Comply with legal obligations.

Your personal information is stored securely using current industry standard security practices to prevent unauthorised access, disclosure, modification, or loss. Access to your information is limited to personnel who require it to provide services to you.

I use systeme.io as my course delivery and customer relationship management platform. As such, your personal data may be stored on servers located outside Australia, including the United States and Europe. We take reasonable steps to ensure that any overseas recipients of your personal information do not breach the Australian Privacy Principles or are subject to similar privacy obligations.

By using our services, you consent to this transfer of information and acknowledge that foreign entities may not be subject to Australian privacy laws.

I do not sell, rent, or share your personal data to third parties for their own marketing purposes. I may however use trusted third party services (eg payment processors, email marketing platforms) to facilitate our services, and they are required to handle your data securely and only for the intended purposes.

You have the right to access, correct, or delete your personal data held by us. To exercise these rights or if you have any concerns, please email childrensassistant@nicolemoffat.com.au.

By using our services, you consent to the collection, use, and disclosure of your personal information as described in this section.

By adhering to these general conditions of sale, you acknowledge having read our personal data protection policy and consent to our collection and use of this data. By entering your email upon enrolment, you consent to receiving emails pertaining to the purchase of products and information about our services if you request it. You can unsubscribe from emails at any time.

Article 7: Cookies

We use cookies and applets to improve the experience for you, the user. These cookies allow us to increase your security and are a way of monitoring user access.
This non-personal information is collated and provided to us to assist in analysing the usage of the site.

All content is original and created by me (Nicole Moffat), and illustrations created using licensed stock imagery. It is designed and produced by the author using Canva Pro. Copyright protection is applied automatically in Australia. I own all intellectual property. No part of my books may be reproduced, distributed or copied without prior written permission, or represented as someone else's work.

Article 8: Limitations and Disclaimers

The ideas, concepts, attitudes and principles offered in my books are based on researched, practiced and contemporary approaches to Early Childhood Education and parenting. They are intended as guiding ideas only and do not replace professional or medical advice. We believe if these concepts are taught, and practices are enacted with consistency, they can only improve relationships and wellbeing. Without being present to coach, oversee or teach these guidelines personally I cannot make any guarantee of their effectiveness. We advocate for a whole school/family/community approach.

To the extent permitted by law, we are not liable for indirect or consequential loss, loss/damage resulting from the misuse of our products, or delays in delivery beyond our control. Nothing in these terms and conditions excludes rights under Australian Consumer Law.

Article 9: Governing Law These terms and conditions are governed by the laws of Victoria, Australia. Any disputes will be subject to the jurisdiction of the courts of Victoria.
