General conditions of sale
Article 1: Scope of application
These general conditions of sale apply to all transactions concluded through the websites of the NICOLE MOFFAT network. Is considered as "client" any natural or legal person making with the company NICOLE MOFFAT an order validated via our secure payment platform, or by check or cash.
Article 1a: Age limit
Age restrictions apply: The company NICOLE MOFFAT only accepts clients over 16 years old (for physical and electronic products) and over 18 years old (for services: coaching, workshops, seminars). We do our best to restrict access to our sites, products and services to minors. Even if the content of our products and services is not of a shocking nature, we prefer to target a mature audience capable of understanding the implications and responsibilities of the business world. Any subscriber/purchaser who does not meet these criteria (age over 16) will be immediately deleted from our database as soon as this is brought to our attention. Likewise, any customer who does not meet these criteria will be immediately reimbursed.
Article 2: Order
Any order placed on a site belonging to the company NICOLE MOFFAT implies full and unreserved acceptance of these general conditions of sale.
Article 3: Price and Service
The prices are indicated in Australian Dollars with all taxes included. The price of items can be changed at any time. However, the price applied to an order will be that announced at the time of the order.
For your one-time payment you will receive a link to enrol in the We Can Do This e-course. You have ongoing access to your course modules. There are no ongoing fees or add-ons.
Article 4: Payment
Payment is due immediately on the date of the order, including for pre-order products. You can pay by credit card. Cards must be international bank cards (Mastercard or Visa). We do not accept American Express. Secure online payment by credit card is made through the company Paypal. The information transmitted is encrypted by software in the rules of the art and cannot be read during transport over the network. Any guarantee as to the security of this system is entirely the responsibility of the company Paypal and cannot be attributed to us.
Article 5: Delivery
Delivery is made to the email address you specified when placing your order (therefore, pay particular attention to the spelling of the address you enter). In the event of an email not being received after purchase, please contact us so it can be rectified.
Article 6: Protection of personal data
We are committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPS).
When you enrol in my course, access my services or interact with us, we may collect your personal information including (but not limited to) your name, email address, payment details, and any other information you choose to provide.
We collect this information to:
Provide access to the e-Course We Can Do This and related services;
Process payments;
Communicate with you about your enrolment or our services;
Improve our services and user experience;
Comply with legal obligations.
Your personal information is stored securely using current industry standard security practices to prevent unauthorised access, disclosure, modification, or loss. Access to your information is limited to personnel who require it to provide services to you.
I use systeme.io as my course delivery and customer relationship management platform. As such, your personal data may be stored on servers located outside Australia, including the United States and Europe. We take reasonable steps to ensure that any overseas recipients of your personal information do not breach the Australian Privacy Principles or are subject to similar privacy obligations.
By using our services, you consent to this transfer of information and acknowledge that foreign entities may not be subject to Australian privacy laws.
I do not sell, rent, or share your personal data to third parties for their own marketing purposes. I may however use trusted third party services (eg payment processors, email marketing platforms) to facilitate our services, and they are required to handle your data securely and only for the intended purposes.
You have the right to access, correct, or delete your personal data held by us. To exercise these rights or if you have any concerns, please email childrensassistant@nicolemoffat.com.au.
By using our services, you consent to the collection, use, and disclosure of your personal information as described in this section.
By adhering to these general conditions of sale, you acknowledge having read our personal data protection policy and consent to our collection and use of this data. By entering your email upon enrolment, you consent to receiving emails pertaining to the delivery of your course and our services. You can unsubscribe form emails at any time.
Article 7: Cookies
We use cookies and applets to improve the experience for you, the user. These cookies allow us to increase your security and are a way of monitoring user access.
This non-personal information is collated and provided to us to assist in analysing the usage of the site.
Article 7: Intellectual Data
We Can Do It e-course is original content created by me (Nicole Moffat), referenced with sources of supporting academia. Copyright protection is applied automatically in Australia. I own all intellectual property. This course material is not to be reproduced, distributed or represented as someone else's work.
Article 8: Limitations and Disclaimers
The ideas, concepts, attitudes and principles offered in We Can Do It are based on researched, practiced and contemporary approaches to Early Childhood Education. We believe that these approaches, when enacted by teams and centres collectively, and by individuals as they relate to children, can only improve relationships, wellbeing and engagement. However, without being present to coach, oversee or teach these principles we cannot make any guarantee of their effectiveness. When educators are not given the conditions necessary to enact these principles, the effectiveness is likely to be compromised. We advocate for whole centre professional learning and change of practice.
